1) Who we are

2) Acceptance of Terms
By accessing or using this site, you agree to these Terms. If you do not agree, do not use the site.
3) Scope of the site & services
This site is a marketing/lead-generation landing page for painters interested in reserving a city with PaintSignal’s agency services. No user accounts, no software downloads, and no on-site purchases are offered. Any commercial relationship, fees, and deliverables are handled off-site after a virtual meeting and governed by a separate signed agreement.
4) Eligibility; age
You represent that you are 18 years or older and have the authority to enter these Terms.
5) Limited, view-only license
We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the site solely to evaluate our services and submit an inquiry. All other rights are reserved. You may not copy, reproduce, modify, distribute, or create derivative works from any site content without our prior written permission.
6) Intellectual property
PaintSignal™ and associated logos are trademarks and trade names of PaintSignal Inc., whether registered or unregistered. All rights are reserved. You may not use our trademarks, trade dress, or name without our prior written permission. Any goodwill arising from permitted use inures to PaintSignal Inc.”
7) Acceptable use
You agree not to: (a) scrape, crawl, index, or harvest data; (b) probe, scan, or test vulnerabilities; (c) interfere with site operation; (d) reverse engineer code; (e) send spam or malicious code; (f) impersonate another person; (g) use the site for any unlawful purpose.
8) Third-party services & links
The site may reference or integrate third-party services (e.g., Meta, Google, GoHighLevel, telephony providers). We are not responsible for third-party sites or terms. Use them at your own risk.
9) Communications; recording; automated assistant
Calls to and from PaintSignal may be monitored or recorded for quality and training. Our digital/automated assistant may answer calls and messages to help with scheduling and questions. Where required by law, we obtain your consent for marketing texts/calls (including prerecorded/automated voice and ringless voicemail) via the consent language presented at our forms or when you message us. Where recording applies, we announce this at the start of the call (“This call may be recorded for quality and training”). If you do not consent, please disconnect and contact us by email at [email protected].
SMS PROGRAM TERMS are included in Section 16 of these Terms. Use of email and SMS is further described in our Privacy Policy.
10) Payments, refunds, and chargebacks (site)
No payments are processed on this site. If you later pay for services under a separate agreement (e.g., via Stripe or Wise), that agreement controls all payment, refund, and billing terms. If you believe a charge is incorrect, contact us first at [email protected] so we can investigate. We reserve the right to contest chargebacks that are improper or contrary to the governing agreement and applicable network rules. This section does not limit any rights you may have under law or card-network rules.
11) No guarantees on the site; contract controls
Any performance guarantees (for example, estimates-in-90-days or similar) apply only if expressly set out in a separately signed agreement. Otherwise, services are provided “AS IS” with no warranties (see Section 13).
12) Disclaimers
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES (EXPRESS, IMPLIED, STATUTORY), INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the site will be uninterrupted, secure, or error-free.
13) Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAINTSIGNAL INC. WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED USD $500. These limitations do not apply to liability that cannot be limited under applicable law, or to our fraud, willful misconduct, or a failure to implement reasonable security measures resulting in unauthorized disclosure of personal information. The foregoing limits also do not reduce any fees you owe under a separate agreement or your indemnity obligations in Section 13A.
14) Indemnity
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless PaintSignal and its officers/directors/employees from and against claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of: (a) content you submit to us (including via forms, SMS/MMS, voicemail), (b) your use of the site in violation of these Terms or law. This Section does not apply to the extent a claim is caused by our own failure to follow applicable law or our written instructions.
15) Dispute terms
Governing law & venue. These Terms are governed by the laws of Ontario, Canada. Venue lies in Vaughan, Ontario (or another competent Ontario court).
No arbitration. There is no arbitration clause in these Terms.
Individual actions; small-claims; jury waiver. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND PAINTSIGNAL WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS OR REPRESENTATIVE ACTION; DISPUTES MUST BE BROUGHT INDIVIDUALLY. EACH PARTY WAIVES ANY RIGHT TO A JURY TRIAL and agrees to a bench trial. Nothing here prevents either party from bringing an individual claim in small-claims court if eligible.
Non-waivable U.S. rights preserved. Nothing in this Section limits any non-waivable consumer privacy rights or remedies under applicable U.S. state or federal law (e.g., CPRA/CCPA or other state privacy laws) for residents of those jurisdictions.

Sender: PaintSignal Inc. via a 10DLC-capable number that receives inbound SMS and calls +1 (470) 798-4848.
Purpose / message categories
Scheduling and availability; appointment confirmations/rescheduling; reminder notices; city-reservation status; qualification follow-ups; decision follow-ups; operational support updates.
Opt-in
By submitting your phone number on our forms or by messaging our number, you agree to receive messages from PaintSignal. Consent is not a condition of purchase.
Frequency
Message frequency varies. During active scheduling and reminder windows, messages may be more frequent; otherwise typically 2–4 messages per month. Messages may be recurring.
Opt-out (STOP)
Reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to cancel at any time. A single opt-out confirmation message will be sent, after which you will no longer receive messages.

Voice & voicemail notifications
Your consent to our SMS program also covers prerecorded/automated voice calls and ringless voicemail messages related to the purposes above. Calls to and from PaintSignal may be monitored or recorded for quality and training.
Quiet-hours and attempt policy (operational)
We send outbound marketing messages 8:00 a.m.–8:00 p.m. recipient-local and limit combined outbound attempts per recipient (SMS + calls + voicemail) to no more than 3 in any 24-hour period. If you message us after hours, we may send a single neutral acknowledgment and resume during allowed hours.
Data use
We log consent status, delivery, and STOP/HELP events to comply with carrier and legal requirements.
17) Electronic communications; preferred channel
By using the site or contacting us, you consent to receive communications from us electronically (email, SMS, or site notices). Email is our preferred channel for notices and customer care.
18) Privacy
Our Privacy Policy explains how we collect, use, disclose, retain, and secure information, and your choices and rights. It is incorporated by reference.
19) Changes to these Terms
We may update these Terms from time to time. The “Effective date” will change when we do. Material changes will be communicated by email/SMS when appropriate.
20) Miscellaneous
We are not liable for delays/failures due to events beyond our reasonable control.
Assignment. You may not assign these Terms without our consent; we may assign in connection with a business transfer.
Severability. If any provision is found unenforceable, the remainder remains in effect.
Waiver. No waiver is effective unless in writing.
Entire agreement. These Terms constitute the entire agreement regarding site use and supersede prior or contemporaneous communications about the site.
